§1 Scope of application
The following terms and conditions apply to all contracts relating to the rental of any limousine and any other services.
A contract comes into effect only if goBest24 Limousine Service has accepted this in writing and has also given its consent in the form of a confirmation.
§2 Payment terms
Unless otherwise agreed in writing, the invoice amount is due at the latest immediately before the start of the journey. Unless otherwise agreed in writing, upon receipt of the written confirmation by the customer, half, i.e. fifty percent (50%) of the price in the form of transfer to the account of the goBest24 Limousine Service. The customer undertakes to pay the second half of the price, also at the latest one week after the end of the order, in the form of the transfer, to the account of the goBest24 Limousine Service. In the case of short-term bookings, the agreed provisions apply. Deviating regulations can be made and must be agreed in writing with goBest24 Limousine Service and recorded as a supplement to the order in writing.
In the event of default of payment, goBest24 Limousine Service will charge the customer with customary interest in the amount of the bank's own facility loans, plus a handling charge of 2.5% and dunning charges of € 10 per warning letter. Payment is due from the 1st day of the due date of the invoice amount. If, after the third reminder, the due invoice has not been settled, goBest24 Limousine Service is entitled to initiate legal proceedings.
Cancellations must be made in writing. The following shares of the agreed price shall be deemed as expenses:
- up to 14 days before travel: no charge
- up to 7 days before travel: 50%
- up to 24 hours before travel: 75%
- less than 24 hours before travel: 100%
Percent of the agreed price. Days are both business days, weekends and holidays.
goBest24 Limousine Service is entitled to rescind the contract at any time if the performance of the journey should become impossible, except in cases of intent or gross negligence of goBest24 Limousine Service.
In the event of a failure due to force majeure, the price shall not be calculated or calculated according to the expired part of the contract.
When placing orders to third parties, the customer and goBest24 Limousine Service are contract partners. Orders must show the exact item, process and the end customer or customer.
Increased costs for delays are to be borne by the customer according to the respective valid prices, insofar as they do not result from negligence of goBest24 Limousine Service.
There is no obligation to transport. The driver of the vehicle is authorized to do so.
In the case of an offense or if the road traffic is endangered according to the traffic regulations, goBest24 Limousine Service or the driver is entitled to exclude passengers from the trip or to terminate the journey. The full agreed purchase price, including all additional costs, is due. This also applies to vehicle damage or non-use of the vehicle. The consumption of drinks and food as well as smoking in the vehicle are not permitted. During the journey, a seatbelt is required.
The transport of pets is to be agreed with goBest24 Limousine Service in the individual case.
§7b Behavior of the passengers
Passengers have to behave during the journey and on the vehicle in the same way as the safety and order of the company, their own safety and the respect for other persons and things. Instructions of the personnel are to be followed.
Passengers are, in particular, prohibited from talking to the vehicle driver during the journey, opening the doors during the journey, holding or throwing objects out of the vehicles. Every passenger is required to fasten the seatbelt in the vehicle. If a passenger violates the obligations under paragraphs 1 to 6, despite his reminder, he may be excluded from transport.In the case of deliberate contamination of the vehicle, the cost of cleaning shall be charged to the passenger; Further claims shall remain unaffected. The cleaning fee is payable to the staff.
Persons who represent a danger to the safety or organization of the holding or to the passengers are excluded from transport. This applies in particular to: Persons who are under the influence of alcoholic beverages or other intoxicating substances and / or persons with firearms, unless they are authorized to carry firearms. Children who are not compulsorily in school, before their 6th year of age, can be excluded from transport, provided they are not accompanied by an adult supervisor throughout the course of the journey. The goBest24 Limousine Service driver decides about the exclusion from the transport.
§8 Liability of goBest24 Limousine Service
No liability is assumed for any damage or vehicle failure, unless it is due to intent or gross negligence of goBest24 Limousine Service. Damage claims due to vehicle failure are excluded.
goBest24 Limousine Service is obliged to provide a car that is approved and TÜV - tested and insured as a rental vehicle.
§9 Liability of the customer
The customer is liable for all damage and contamination caused by him and the passengers traveling with him. Labels or decorations (by prior agreement) must be removed by the customer. The customer is liable for consequential damages.
§10 Place of jurisdiction
The jurisdiction for all parties involved is Hamburg.
In addition, the exclusive jurisdiction shall be Hamburg for all current and future claims arising from the business relationship with full-time merchants, legal persons under public law or public special funds, including bills of exchange and checks.
The same court of jurisdiction shall be where the purchaser has no general court of jurisdiction within the territory of the country, his domicile or habitual residence is removed from the territory of the country or his place of residence or habitual abode is not known at the time the action is brought.
§11 Partial ineffectiveness
Should one of the above provisions not be effective, the remaining provisions shall remain unaffected. In this case, the provisions which are most closely related to the facts of the clause which are to be omitted are to be applied.
The declaration of the contract can be revoked in text form within 2 weeks, from receipt of the booking, without giving reasons. This period begins with receipt of the instruction / booking. The punctual sending of the revocation is sufficient for the revocation period. In the case of short-term bookings (booking and travel start within 1 week), the right of withdrawal does not apply.

The right of revocation expires prematurely when goBest24 Limousine Service has begun with execution of the service before the end of the revocation period.
